If some starts misleading by incorrect facts don't start believing and circulating the same without authentication.Mohit,  I am talking about the person on whose information you have circulated the below e-mail on the blog.

I have copy of the petition filed by the builders. Entire order of the High Court is challenged  on the ground of  "Project on land title, illegal change of land use and impact Enviornment factors on the propose project of SWMP in the residential area" in the petition filed in Supreme Court by builders i.e Ansal's as well as Crossings . It is totally incorrect on your part to say that the case in Supreme Court is for recovery of this 1 Crore and not to halt any construction of DG without reading the case file authenticating the correct facts. Although there is no formal stay order on construction in the petition but notice was issued to all the govt. authorities after hearing the advocate for the builders. GNN very well know that till date they don't have Enviornment Clearance from the State as well as Central authorities that's why the work of throwing garbage/kuda has not yet started as it have the implication of inviting criminal action against them. Till date this all drama is for the amount  Rs. 12 crore out which 6-7crore is already been used only for boundary wall by GNN without clearance of the project. Till date GNN do not have all the compliance in place which are mandatory for the project to proceed .They are in big trouble and start using the verdict of High Court order in their favor. High Court order no where says for green signal for the project. It only says that 14 acre land was declared as non-residential proposed for Dumpyard. But to construct Dumpyard/SWMP, GDA has to provide a proper sufficient land and GNN has to meet out all the compliances before taking up the project. It is the misconception of GNN and GNN is trying to mislead the public via media channels about High Court order in their favor. High Court order will take final shape only on the outcome of builders petition pending in Supreme Court on which notice is already been issued which is a very big victory as of today for the builders as well for us.

It is true that all those who has invested in Crossings Republik are victim at the hands of builder as well as the govt authorities in the present case. In this case builders are also a victim at the hands of Govt. authorities. In India, almost all land deals made by builders have something or the other shady things. But it is the govt.authorities which make these things in favour of builders wherein unending the land litigation starts.

It is totally incorrect that builders petition in Supreme Court is for recovery of their 1 Crore penalty and to delay judgement as long as possible to help them to sell as many flats as possible and then let the residents fend for themselves. Mohit, as per High Court order builders has deposited Rs.1 crore penalty imposed on them. Please understand that Supreme Court hear the matter only, if any penalty imposed by any High Court order which an affected party is challenging in Supreme Court is deposited by the affected party. So, builders have just deposited the penalty imposed as per directions. Don't misguide the people reading the blog. Mohit , half knowledge is always dangerous. It is a general human tendency that once somebody tells you something and you start believing in the same manner and make certain assumptions.Hence it would be advisable to use the platform of this forum for just discussing and sharing thoughts and ideas instead of predicting about someone's incorrect knowledge and creating doubt among others.           

But to be on safer side still we still have time , I am repeatedly saying that to stop this controversy..residents must file intervening application in the builders petition pending in SC separately by individual name or through CROMA as an association and ask for stay on the construction activity. These days courts are more in favor of residents rather builders. Although in the present case builders have strong documents in their favor otherwise their petition would have been thrown and dismissed on the very first day of listing. But this need to done with unity and proper funds in hand. 

CROMA is going to take call on this very soon and  will again discuss with some lawyer to take action as per advise. Also path of National Green Tribunal is in pipeline.      

Simultaneously we can keep our efforts on for escalating the matter to reach the level of new U.P. Chief Minister Akhilesh Yadav and keep our finger cross. This is the reason this protest on 15th April was kept for to bring into the knowledge of all those new people who have joined at various important post in govt authorities specially in the city Ghaziabad after the change of U.P.Govt.   
   
Please don't create panic among the group by writhing such things without having full knowledge of the matter. Hope I didn't said anything which hurts you. Everyone is open to take advise from any legal expert and take individual action accordingly. CROMA has not bound anyone for taking any action in the subject matter. Legal recourse is open for everyone whosoever is affected party.But filing many petitions individually may have impact of weakening the case stand of others.

The Latest update that i got is that SP-City,Ghaziabad facilitated an Appointment with Concerned Officer in GNN.

Our Croma Team members then visited GNN and had a detailed discussions with them.

GNN raised some points,which are as under-

1. Did the Approval/Construction of Crossings Start Before the Approval of DG??

5. GNN Says that the Waste of Ghaziabad has to be disposed of Near Ghaziabad and taking it far will not be economical.
6. They empathise with us and admit that Residents have been cheated by these builders and the case that is now pending in Supreme Court is for recovery of their 1 Crore Penalty and to delay judgement as long as possible to help them to sell as many flats as possible and then let the residents fend for themselves.

7. GNN also assured Team CROMA that they are using latest technology and this DG will not be as GHAZIPUR. However, we know only too well ,How the Mango Man in this Country has been and will be swindled by one and all.

Look at the Promises made in the Advt. and Sales Brochures by the Builders and how Crossings was hailed as India's First Global City!!!!!!

We now should study very carefully what is the Legal Case that is going on in Supreme Court and then come together to formulate a Strategy for Future Course of Action.

One Clear Benefit of Last Sunday's Agitation was that we now know what is the truth and any hopes of expecting a favorable judgement from Supreme Court based on facts put up by the builder is just Day Dreaming.

These Builders only want to minimize their losses and are not fighting on behalf of us.

We wish to express our sincere gratitude to all for the success of the protest that crowd at NH-24 was noticed by police authorities on which city SSP took a call with the team for meeting to discuss about the matter. Accordingly CROMA team meets with City SSP with the representation of GNN about the matter for discussion.
