Dear Sir(s),
 
We refer to above and as mentioned in our above communication once again wish to draw your attention towards  our disagreement on Township Maintenance Charge (TMC) imposed by you as the same are not payable in view of provisions of U.P.Apartment (Promotion of Construction, Ownership and Maintenance) Act and directions given by ADM-City vide order dated 20.02.2014 , copy annexed herewith for reference .
 
Please note we deny all the contents regarding the facilities mentioned in letter dated 08.02.2014 written by CIPL addressed to President-CROMA except the one which are admitted and applicable. This is inform you that facilities provided at the township level has been made out of External Development Charges (EDC) paid by flat owners and many facilities which was supposed to be constructed out of those EDC are still at under construction stage and you will be availing the benefit of interest on the EDC fund not utilised till date TMC can be adjusted from the interest part accruing monthly in books of accounts. Also in many  society @ Crossings Republik ,  construction is going on in full swing and heavy construction vehicles are damaging the external roads, therefore  the  residents should not be ask to bear burden of TMC  to maintain the such roads & infrastructure.  
 
While on the subject before proceeding further we request you to provide us following detail.
 
a)         Basis on which maintenance vendor are appointed for various purposes at township level.
b)         Basis on which maintenance charges of Rs. 0.30 PSF is arrived at.
c)         Actual expense being incurred on maintenance of township with break up and supporting documents.
d)         Total Approved Area alongwith approved map of Township in which this TMC is getting distributed inclusive of Occupied/unoccupied units, under construction area.
e)         Income generated from outdoor media by way of hoardings,  pole kiosk, billboards, banners and even quarterly magazine i.e. Crossings Insight.
 
Further We would like to draw your attention towards the following key issues pending with you for necessary action as per UP Apartment (Promotion of Construction, Ownership and Maintenance) Act,  2010.
 
                     i.               Completion Certificate from the concerned competent authority as per building bye-laws for the compliance of clause (5) of Section- 4 of the UP Apartment Act 2010.
                   ii.               Form of Declaration in form-A as per UP Apartment (Promotion of Construction, Ownership and Maintenance) Rules, 2010 as required in Section 12 of the Act.
                  iii.               Registration of Deed of Apartment to be executed for appropriate transfer deed with the true copy of "Form of declaration" in favor of flat owners for the compliance of Section 13 of the Act. However this has not been complied.
                 iv.               Visitor's Parking : No visitors parking have been allocated till date in any of the societies, whereas as per the building bye-laws provision of10% of total parking space is required to be reserved for visitors.
 
Apart from the above statutory requirements, the following necessary facilities and basic amenities which were promised are required to be provided immediately. Request update status of these with expected completion date.
 
                  i.                  Completion of Road Connectivity thru all three road.
a.            Completion of final Layer on completed portion of Road behind GH7 till Noida Extension & Completion of complete road including disputed patch.
b.            Widening of Road between Mahagun Mascot and NH 24.
c.             Widening of Sahberi Pulia
 
                   ii.               Status of start of Proposed Hospital and till than arrangement of Emergency Care Centre.
                  iii.               Provision & Status of Ganga Water / Supply Water?
                 iv.               Provision of Fire Station?
                   v.               Boundary Wall/fencing around the Township and Gate at all entrance. Several time it is reported that CCTV installed are non operational. BY when it will be fully operational.
                 vi.               Electricity
d.      Please share Total Required Load and Sanction load as of now with breakup of distribution to all the society. What is the plan for balance load and by when it will be available.
e.      All resident are supposed to pay Uniform Electricity Tariff as per Govt prescribed rate however in different society different rate is applicable
                vii.               Status of development of park in space between the societies of Assotech, Panchsheel, Ajnara, Supertech & Paramount.
              viii.               Playground & Central Ground Area for Community Activity.
 
Also request you to confirm status/action on balance points from our charter of demand attached herewith.
 
Since, Crossing Infra Pvt. Ltd (CIPL) is prime promoter responsible for all abovesaid infrastructure activities as per township policy under the township is built, therefore, It became prime responsibility to ensure all above from respective builders in Township and revert back with documents and dates of completions with meeting date on or before 8th March'14. Please do mark your response to all addresses is the list and in CC.
 
Therefore it is a humble request that till the above points are concluded,  kindly do not force collection of  TMC Charge from residents or disrupt any services in lieu of this .
