Dear Valued Crossings Republik Resident,

Here is the recent update from CROMA Legal Committee on the Dumping Ground Litigation.

This is just to share that only Ansal's Application for STAY is listed for hearing on 26.02.2013 as per list showing on website. 

Application is listed for further hearing in continuation of last hearing dated 12.02.2013.  As per last order both the respondent i.e the State of U.P. as well as the  Municipal  Corporation  of  Ghaziabad i.e. GNN,  are  directed  to file short affidavits, indicating the manner in which the area around the proposed Waste Management Project, is to be protected from any kind of pollution and the problem relating to health and hygiene. Also the U.P.Pollution Control Board, the respondent No.6 in the Petition is also directed to file a similar affidavit within two weeks.

The CROMA Legal Committee has Checked with Ansal's Advocate, she informed that till date none of the party has filed the Affidavit. She further told that matter in any case is going to be taken up on 26th hearing. As per status, this time only Application for Stay is listed not the main matter . 

Also CIPL & CROMA main petition is not listed. Therefore on behalf of CROMA nothing is require to be done. Lets wait and watch the outcome of Ansal's application. 

As per the CROMA Legal Committee, in case  Govt. Authorities i.e. GNN/State Govt./UPPCB do not file Affidavit then there are chances that Court may grant Stay order to Ansal's  to avoid further adjournment. OR the matter might get further adjourn for the same purpose. But in case the Govt. authorities file the affidavit a two days or a day in advance of the hearing date, for which we are not sure, then Court may hear the arguments and will pass the appropriate order after hearing both parties. This is just a view from CROMA Legal Committee as per circumstances. Let see the outcome of 26th Feb 2013.

The CROMA Legal Committee members are already in touch with the Ansal's Advocate and will meet on Monday morning about the status of filing of Affidavit by the parties and will update the resident on the same.
