Not sure but I guess Below is the case detail as Designarc Infra was one of the party in Allahabad high court order dtd. 14/11/13 for UP Apt Act and probably this has been filed challenging that order, 1st Hearing happened on 24th Feb and next hearing is on 4th March.

हाईकोर्ट के आदेश के बावजूद निर्धारित समयसीमा में डिक्लेयरेशन फार्म न देने वाले बिल्डरों का कॉमन एरिया से अधिकार खत्म हो गया है। अब बिल्डर प्रोजेक्ट की सामुदायिक सुविधाओं पर आरडब्लूए का अधिकार है।

सोमवार को इस मामले में हुई सुनवाई में सुप्रीम कोर्ट ने भी हाईकोर्ट के आदेश को बरकरार रखा। अभी तक सिर्फ कुछ गिनेचुने बिल्डरों ने ही जीडीए में डिक्लेयरेशन फार्म जमा किए हैं।

हाईकोर्ट ने 14 नवंबर 13 को आदेश में स्पष्ट रूप से निर्देश दिए हैं कि निर्धारित समयसीमा में फार्म न जमा करने वाले बिल्डर प्रोजेक्ट्स के इंडिपेेंडेंट एरिया पर रेजीडेंट्स का अधिकार होगा।

सुप्रीम कोर्ट के वकील एसके पॉल ने बताया कि जिन बिल्डरों ने एक्ट लागू होने (2010) से पहले प्रोजेक्ट का नक्शा पास कराया था, उन्हें हर हाल में 90 दिनों के भीतर डिक्लेयरेशन देना अनिवार्य था। इस लिहाज से 14 फरवरी 14 उनके लिए अंतिम डेट थी।

अब भले ही बिल्डर डिक्लेयरेशन फार्म जीडीए में जमा कर दें, लेकिन यह मान्य नहीं होगा। अब जीडीए को ऐसे बिल्डरों के खिलाफ नोटिस जारी कर कार्रवाई शुरू करनी चाहिए।

आरटीआई कार्यकर्ता आलोक कुमार ने बताया कि अब आरडब्लूए ही कॉमन एरिया की मालिक होगी। जीडीए में डाली गईं आरटीआई से जानकारी मिली है कि शहर में सिर्फ एक फीसदी बिल्डरों ने ही डिक्लेयरेशन फार्म दिए हैं।
