Hi , I purchased a flat in Gardenia Square Tower C in Dec 2012 in resale. In Dec2012 this project was already running in late and Penalty was introduced. At the time of resale of the flat I have paid 95% of basic + interest on late payment and transfer charge to the builder while paying all these I enquire with builder for applicability of penalty clause to second owner(my selves) of the flat , builder has assured me that since the property has endorsed and continuing the same agreement and already done all necessary payment so It will be applicable to second buyer of the flat but he refused to give anything in written. Now we received passion latter from builder and finally builder has refused to give penalty to us whereas per builder –buyer agreement 2 year of penalty clause is applicable . Reason given by Builder is - Penalty clause is not applicable to second buyer. Need your help and suggestion how we can claim this amount from builder.
