Subject: No registration of the flats without submitting "Declaration" & "Completion Certificates"

No registration of the flats will be possible without submitting "Declaration" and "Completion Certificates" as per the U.P. Apartment Act Rules 2011.
Due to lack of clarity on the applicability of U.P Apartment (Promotion of Construction, Ownership & Maintenance) Act, 2010 on all building having more than 4 apartments in Uttar Pradesh, irrespective of its date of construction, and the unresponsiveness in implementation on on part of the competent Authorities under the U.P Apartment (Promotion of Construction, Ownership & Maintenance) Act, 2010 the statutory provisions of the said Act are not being implemented and enforced by the owners of apartment, association of owners/RWAs, promoters/developers and the competent Authority.
The non-implementation of the said act and rules is resulting in great hardship to intending purchasers and owners of apartments who are members of various Resident Welfare Association Despite statutory provisions.
Good news came for all of us after rigorous efforts of Federation of Association of Apartment Owners (FedAOA) through its President Mr Alok Kumar who has filed a PIL and the proceeding on the same is going on since yesterday in Allahabad High Court, most of the prayers (heighted in attached file) has been accepted by the GDA, we have requested to honorable court for necessary directions.
Highlights:
1. No registration of the flats will be possible without submitting declaration forms and completion certificates as per the U.P. Apartment Act Rules 2011.
2. Old builders who have sold the flats have to submit the declaration forms and completion certificates within 3 months.
3. All the societies/RWA/Association having more than 4 apartments has to adapt the U.P. Apartment Act within the period of 8 weeks.
